Scarce work concerning the confiscation and nationalization of the assets of the Duke of Monteleone y Terranova. The Duke, actually a Sicilian noble, was also the Marquess of the Valley of Oaxaca, a title first bestowed upon Hernan Cortes, and controlled the estate of Cortes' descendants in Mexico. The matter at hand in this legal opinion was the confiscation of an estate at Cuernavaca and a hacienda at Atlacomulco. The Duke, represented by his administrator Lucas Alaman, hoped to mollify the Mexican government by paying taxes on the properties as an absentee landlord. The case addressed the thorny issue of Spanish grants and rights of the grant holders in a newly independent Mexico; the confiscations were hereby approved in April 1833, but the case continued to be fought through the 1830s. We locate two copies in OCLC, at the Huntington and Yale.
